 I gave this discount code a test run this morning and worked like a charm.  Unlike coupons from other sites, this one applies to sale and clearance items and it appears shipping charges count toward the $40.00 order requirement.  I added a $39.99 item to my cart and with shipping charges the order total was over $40 and I was awarded my $10.00 discount.
